But if you had known what this means, ‘I desire mercy and not sacrifice,’ you would not have condemned the guiltless.

Since we are 200 years removed, and we don’t apply the Old Testament well…we may not hear what Jesus is saying here quite as well as the Pharisees he is saying it to. Surely they knew what Deuteronomy 19:18 said…

And the judges shall make careful inquiry, and indeed, if the witness is a false witness, who has testified falsely against his brother, then you shall do to him as he thought to have done to his brother; so you shall put away the evil from among you.

What Jesus is telling them, along with the fact that they are just flat wrong, is that the penalty for Sabbath-breaking  is really theirs, because they have leveled a false accusation.
